Qont Hardware Legal

This Hardware Legal Policy applies to PRI Servers, data centre units, edge units and any physical hardware supplied, resold or provisioned by Qont. It outlines the legal terms, responsibilities, limitations and service conditions that govern all hardware acquired through Qont or used with Qont systems. These terms apply whether the hardware is purchased, leased, provisioned or supplied through a Qont program.

This policy does not replace the customer’s OEM agreement. It defines Qont’s involvement, obligations and limitations.

Scope of This Policy

This policy applies to all physical hardware sourced through Qont or supplied for use with Qont systems. It covers servers, integrated units, enclosures, edge devices and data centre hardware. The policy applies to all regions unless a local requirement overrides a clause.

OEM warranty terms remain authoritative. This document governs Qont’s position and role when assisting customers.

Qont’s Role and Responsibilities

Qont supplies hardware for use with Portable Risk Intelligence technologies. Qont is not the manufacturer of this hardware.

As a result:

• Qont does not issue manufacturer warranties.

• Qont follows OEM warranty conditions.

• Qont may assist in communicating with OEM service teams.

• Qont may provide guidance based on OEM findings.

• Qont does not guarantee specific repair or replacement outcomes.

All final decisions follow OEM assessments unless Qont elects to offer a discretionary remedy.

Warranty Coverage

Hardware supplied through Qont is covered exclusively by the OEM warranty.

Coverage is limited to manufacturer faults, which may include factory defects, internal component failures and manufacturing errors.

Qont does not determine OEM fault criteria and does not override OEM findings.

Qont does not cover:

• Physical damage

• Environmental damage

• Electrical surges

• Liquid contact

• Negligence

• Incorrect installation

• Inappropriate environment

• Heat, dust or moisture exposure

• Damage from third party technicians

• Modifications to hardware

• Damage from non Qont software

• Tampering with firmware or protected system areas

Software and System Integrity Requirements

System integrity must remain intact for Qont to participate in any assessment.

The following void Qont involvement:

• Tampering with firmware

• Tampering with secure partitions

• Attempts to bypass security layers

• Modification of Qont software

• Any misuse that impacts software integrity

Qont does not cover damages caused by improper software use.

Assessment Process

Qont may help facilitate an OEM assessment. However:

• OEM review times are not guaranteed

• OEM repair or replacement is not guaranteed

• Compensation is not guaranteed

• Inspection or shipping may be required

• Customers are responsible for shipping or callout fees

Qont will provide customers with a summary of the OEM decision once received.

Qont Discretionary Remedies

Qont may offer discretionary remedies in limited cases. These may include:

• Replacement unit at cost

• Discount on a new unit

• Store credit

• Suggested upgrade path

These remedies are optional and depend on availability, region and internal review.

They are not guaranteed.

Exclusions and Limitations

The following are not covered under any circumstance:

• Data loss

• Business or revenue loss

• Downtime or operational delays

• Software corruption

• Incompatibility with customer environments

• Third party configuration issues

• Wear and tear

• Consumables

• Items outside OEM scope

• Any claim outside manufacturer defect criteria

Qont is not liable for operational impacts of hardware failure.

Replacement Conditions

If the OEM confirms a manufacturer fault, remedies will follow OEM policy. These may include:

• Repair

• Replacement

• Refurbished exchange

• Credit

• Decline

Qont does not override OEM outcomes.

Qont may offer a cost priced replacement or credit at its discretion in rare cases.

Hardware End of Life and Support

OEM end-of-life rules apply.

Once a model reaches OEM end of life:

• Support may be reduced

• Support may be removed

• Parts availability may be limited

Qont does not guarantee long term support for discontinued hardware.

Customer Responsibilities

Customers must:

• Maintain hardware in proper environments

• Follow OEM installation and operation guidelines

• Avoid tampering with components

• Ensure safe and stable power input

• Use appropriate cooling

• Follow Qont software integrity rules

• Report issues promptly

Failure to meet these responsibilities may void Qont involvement.

Liability Statement

Qont’s liability is limited to the procedures in this policy.

Qont is not responsible for:

• Incidental damages

• Consequential damages

• Business interruption

• Data loss

• Performance issues caused by the customer environment

• Outcomes determined by OEM decisions

Qont’s maximum responsibility is limited to discretionary assistance.

Acceptance of Terms

Use of Qont supplied hardware confirms acceptance of this policy.

This policy applies internationally unless a region requires an adjustment under applicable law.

Where required, Qont will follow regional regulations while maintaining this policy as the governing baseline.
